By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

CloudberryLane offers an array of yacht charter services such as:

• Daily yacht rentals

• Private events
• Multi-day charters

All offerings are contingent on availability and weather conditions. We have the authority to change or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you must:

• Be at least 18 years of age
• Supply accurate and complete information
• Remit the necessary deposit as noted in your booking confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

Your reservation is considered confirmed only after payment is received and we provide written acknowledgment. We may deny service at our sole discretion.

3.3 Availability

All charters are dependent on the availability of vessels and favorable weather conditions. We will strive to meet your preferred scheduling requests.

4. Payment Terms

4.1 Pricing

All charges are in € and encompass applicable taxes unless specified otherwise. Prices are subject to alteration without prior intimation.

4.2 Payment Schedule

• Deposit: 50% of the full charter cost payable at the time of reservation
• Balance: Must be paid 48 hours prior to the charter departure
• Supplementary charges (if any): Payable at the end of the charter

4.3 Payment Methods

We accept a range of payment methods including major credit cards, bank transfers, and certified checks. Payment processing is secure and encrypted.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• More than 72 hours before departure: Full refund less processing charges
• 24-72 hours before departure: 50% refund
• Less than 24 hours before departure: No refund

5.2 Weather Cancellations

In case our captain deems the weather unsafe, we will propose to:

• Reschedule your charter at no additional expense to the next suitable date
• Issue a complete refund if rescheduling is not feasible

5.3 Mechanical Issues

If mechanical failures occur with your assigned yacht, we will attempt to provide a similar alternative. A full repayment will be issued if no substitute is available.

6. Safety and Conduct

6.1 Safety Requirements

Every passenger must:

• Adhere to instructions from the crew
• Utilize safety gear as required
• Disclose any health conditions impacting their safety
• Stay in designated vessel areas

6.2 Prohibited Items

Items not allowed on board encompass:

• Glass containers
• Illegal substances
• Firearms or weapons
• Large quantities of non-alcoholic drinks beyond reasonable consumption
• Pets without prior permission

6.3 Conduct

Passenger behavior should be considerate and respectful at all times. If behavior disrupts the experience for others or poses a safety risk, we can end the charter prematurely without providing a refund.

7. Liability and Insurance

7.1 Our Liability

We limit our accountability to the charter cost paid. We do not hold responsibility for:

• Personal injuries stemming from passenger carelessness
• Damage to or loss of personal belongings
• Indirect, incidental, or punitive damages
• Schedule interruptions due to weather or situations outside our influence

7.2 Insurance Coverage

Our company maintains comprehensive marine insurance for our vessels and operations. You are reminded to arrange for your own travel and personal insurance coverage.

7.3 Assumption of Risk

By partaking in our services, you recognize that marine activities carry inherent perils, and you assume personal liability for your safety and health.

8. Modifications and Itinerary Changes

We hold the right to adjust itineraries, paths, or schedules due to weather concerns, security protocols, or operational necessities. All efforts will be made to offer comparable alternatives when changes are necessary.

9. Force Majeure

Delays, cancellations, or changes induced by forces beyond our control, such as:

• Extreme weather events
• Natural catastrophes
• Regulatory impositions
• Port shutdowns
• Vessel mechanical faults

shall not render us accountable.

10. Privacy and Data Protection

We manage your confidential information in congruence with our Privacy Policy. Your utilization of our service implies consenting to our information gathering and use as detailed in the Privacy Policy.
